Custom Gaming CMS v4.0 License Agreement

Custom Gaming CMS (CCMS v4.0), created by Erik Hillis, is a copyrighted work of authorship. Erik Hillis retains ownership of the Software and any copies of it, regardless of the form in which the copies may exist. This license is not a sale of the original Software or any copies.

By installing and using CCMS on your server, you agree to the following terms and conditions:

A CCMS v4.0 license grants you the right to run one instance (a single installation) of the Software on one web server and one web site for each license purchased. Each license may power one instance of the Software on one domain. For each installed instance of the Software, a separate license is required.

The Software is licensed only to you. You may not rent, lease, sublicense, sell, assign, pledge, transfer or otherwise dispose of the Software in any form, on a temporary or permanent basis, without the prior written consent of Erik Hillis.

You may terminate it at any time by uninstalling the Software and destroying any copies in any form. If you change your website domain name where CCMS is running you must notify Erik Hillis of the change.

All customers must submit the URL where they are using (or plan to use) each license. If the url changes, you must notify Erik Hillis of the new url in which the software is being used at.

The Software source code may be altered (at your risk).

The Software may not be used for anything that would represent or is associated with an Intellectual Property violation, including, but not limited to, engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities.

If any of the terms of this Agreement are violated, Erik Hillis reserves the right to revoke the license at any time.

Erik Hillis is not liable for the content of any information on any website powered by the Software.

If you willingly violate any of the agreements you agree to pay Erik Hillis a penalty fee of $1,000 US per offense and up to $50,000 in damages.

Transfer of ownership fee

If you wish to sell your site along with the cms, in addition to notifying Erik Hillis of the change of ownership (which needs to be done before any transaction takes place), a $10 transfer of ownership fee will apply. This does not give you the right to redistribute my script in any way, shape or form. By agreeing to this term, you agree not to sell this CMS apart of your website (transfer of ownership) until a) Erik Hillis has been notified of the change b) A $10 "Transfter of ownership" fee has been paid in full c) The new owner of the license has fully agreed to these terms and conditions.

Erik Hillis reserves the right to modify these terms at any time.
